TERMS AND CONDITIONS

1. BASIC PROVISIONS

1.1 Operator of the Online Store

These Terms and Conditions govern the rights and obligations between the Seller and the Buyer when purchasing goods through the online store operated at the website hhclife.cz.

The Seller is an entrepreneur registered in the Czech Trade Register.

Hereinafter referred to as the “Seller”.

1.2 Buyer

The Buyer is a person who places an order through the online store.

The Buyer may be:

a) a consumer,
b) a business entity,
c) a non-business legal entity.

A consumer is a natural person who concludes a contract with the Seller outside the scope of their business activity or independent profession.

A business entity is a person who concludes a contract in connection with their business activity.

1.3 Applicable Law

The rights and obligations of the Seller and the Buyer are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, Act No. 634/1992 Coll., on Consumer Protection, and applicable European Union legislation.

Consumers from other Member States of the European Union retain the rights granted to them by mandatory provisions of the laws of their country of habitual residence.

The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

1.4 Alternative Consumer Dispute Resolution

The Czech Trade Inspection Authority is responsible for out-of-court consumer dispute resolution arising from purchase contracts:

Consumers may contact the Czech Trade Inspection Authority if they are unable to resolve a dispute directly with the Seller.

1.5 Supervisory Authorities

The Seller is supervised mainly by:

a) the Czech Trade Inspection Authority,
b) the relevant Trade Licensing Office,
c) the Office for Personal Data Protection,
d) other public authorities within their legal competence.


2. ORDER AND CONCLUSION OF THE PURCHASE CONTRACT

2.1 Product Offer

All presentations of goods in the online store are for informational purposes only. The Seller is not obliged to conclude a purchase contract regarding such goods, especially in cases of stock depletion, incorrect pricing, obvious technical errors, or suspected violation of legal regulations.

2.2 Order

The Buyer orders goods through the order form in the online store.

Before submitting the order, the Buyer is allowed to review and change the data entered into the order.

By submitting the order, the Buyer confirms that they have familiarized themselves with these Terms and Conditions and agree to them.

2.3 Conclusion of the Contract

The purchase contract between the Seller and the Buyer is concluded at the moment the Seller confirms the order via e-mail.

The Seller reserves the right to refuse or cancel an order especially in cases of:

a) unavailable goods,
b) obvious pricing or product description errors,
c) false or incomplete customer information,
d) suspected violation of legal regulations,
e) suspicion that the order was placed by a person under 18 years of age,
f) repeated refusal to accept shipments,
g) impossibility of delivery to the selected country,
h) restrictions on a particular product in the destination country.

2.4 Language of the Contract

The purchase contract is concluded in the Czech language.

2.5 User Account

If the online store allows registration, the Buyer may purchase goods through a user account.

The Buyer is obliged to protect access credentials to their user account and not disclose them to third parties.

The Seller may cancel a user account especially if the Buyer violates these Terms and Conditions or applicable legal regulations.


3. PRICES AND PAYMENT TERMS

3.1 Product Prices

The price of goods is listed for each product in the online store.

Prices include all applicable taxes and fees unless stated otherwise.

Prices do not include shipping costs, payment fees, or additional services unless explicitly stated otherwise.

3.2 Total Order Price

The total order price consists of the product price, shipping costs, selected payment method fees, and any additional services selected by the Buyer.

The Buyer is informed of the total price before submitting the order.

3.3 Payment Methods

The Buyer may pay using methods available in the online store, especially:

a) bank transfer,
b) cash on delivery,
c) online payment methods,
d) other methods available in the online store.

3.4 Due Date

If payment in advance is selected, the Buyer must pay the total order price within 15 days from the conclusion of the purchase contract unless stated otherwise.

The Seller is not obliged to dispatch the goods before full payment has been received unless payment on delivery has been selected.

3.5 Tax Document

The Seller shall issue the Buyer a tax document or proof of purchase and send it electronically to the Buyer’s e-mail address or include it with the shipment.


4. DELIVERY TERMS

4.1 Delivery Countries

The Seller delivers goods within the Czech Republic and selected Member States of the European Union according to the current shipping offer displayed in the online store.

Delivery availability may vary depending on the destination country, product type, carrier, or current legal restrictions.

The Seller reserves the right to restrict or refuse delivery of a particular product to a certain country if there is reasonable suspicion that delivery could violate the laws of the destination state.

4.2 Shipping Methods

Goods may be delivered through carriers such as:

a) Zásilkovna,
b) PPL,
c) DPD,
d) DHL,
e) Czech Post,
f) other carriers according to the current online store offer.

Available shipping methods are displayed during checkout.

4.3 Delivery Time

Estimated dispatch times are displayed in the online store.

For goods in stock, the Seller usually dispatches orders as soon as possible after payment is received or after conclusion of the contract if payment on delivery was selected.

Delivery times are indicative and may be affected by carriers, destination country, holidays, seasonal demand, customs checks, security inspections, or circumstances beyond the Seller’s control.

4.4 Acceptance of Goods

The Buyer is obliged to accept the goods at the address specified in the order or at the selected pickup point.

The Buyer must provide a correct and complete delivery address, e-mail address, and phone number.

If incorrect or incomplete information is provided, the Seller is not responsible for failed or delayed delivery.

4.5 Transfer of Risk

For consumers, the risk of damage passes to the Buyer upon receipt of the goods.

For business customers, the risk of damage passes upon handing over the goods to the first carrier unless agreed otherwise.

4.6 Transfer of Ownership

Ownership of the goods passes to the Buyer upon full payment of the purchase price and receipt of the goods.

4.7 Damaged Shipments

The Buyer is obliged to inspect the shipment packaging upon delivery.

If the packaging is damaged, the Buyer is advised to notify the carrier and the Seller without undue delay.

If the goods are damaged, the Buyer should contact the Seller at info@hhclife.cz and provide photographs of the damaged packaging and goods.

4.8 Failure to Accept Shipment

If the Buyer unjustifiably fails to accept the ordered shipment, the Seller has the right to claim compensation for actual costs incurred in connection with shipping, packaging, return shipping, and order administration.

Failure to accept a shipment is not considered a valid withdrawal from the contract.

The Buyer may request re-shipment of the order, in which case they must pay the new shipping costs in advance.

In the event of repeated refusal to accept shipments, the Seller reserves the right to reject future orders or require advance payment.


5. INTERNATIONAL SHIPPING AND LOCAL LEGISLATION

5.1 Buyer’s Responsibility for Local Laws

The Buyer acknowledges that the legal status of certain products may differ between countries.

Before placing an order, the Buyer is responsible for verifying whether the ordered product is legal in the destination country or territory and whether its import, possession, purchase, and use are permitted.

By placing an order, the Buyer confirms that:

a) they are over 18 years old,
b) the purchase and use of the products are legal in their country or territory,
c) they have verified local laws applicable to the ordered product.

All responsibility for verifying the legality of the product in the destination country passes to the Buyer at the moment the order is placed.

5.2 Payment by Bank Transfer

If the Buyer chooses payment by bank transfer or another prepaid payment method, the Buyer confirms by making the payment that:

a) they are over 18 years old,
b) the product is ordered in compliance with the laws of their country or territory,
c) the product is legal at the delivery destination,
d) possession and use of the product comply with the laws of the destination country.

By making the payment, responsibility for verifying the legality of the product in the destination country passes to the Buyer.

5.3 Limitation of Seller’s Liability

The Seller is not liable for:

a) detention of shipments,
b) seizure of shipments,
c) import restrictions,
d) destruction of shipments,
e) delivery delays,
f) or other actions by public authorities in the destination country,

if such actions result from local laws, customs inspections, or decisions of authorities in the destination country.

This does not affect consumer rights that cannot be excluded or limited under applicable laws.

5.4 Sales Restrictions

The Seller reserves the right to refuse or cancel orders to countries or territories where certain products may be restricted or prohibited.


6. COLLECTOR’S ITEMS AND RESTRICTIONS OF USE

6.1 Nature of Products

All products offered in the online store are sold exclusively as:

a) collector’s items,
b) aromatic products,
c) technical products,
d) decorative products,

unless explicitly stated otherwise for a specific product.

6.2 Products Not Intended for Consumption

Products are not intended:

a) for consumption,
b) for smoking,
c) for vaporization,
d) for inhalation,
e) or for any use contrary to the laws of the Czech Republic or the destination country.

The Buyer acknowledges that the products are not food, medicines, or dietary supplements unless explicitly stated otherwise.

6.3 Age Restriction

The purchase, possession, or use of products is permitted only for persons over 18 years of age.

By placing an order, the Buyer confirms that they meet the minimum age required by the laws of their country or territory.

6.4 No Health Claims

The Seller makes no medical, therapeutic, or health claims regarding the products.

All information provided in the online store is for informational purposes only.

6.5 Buyer Responsibility

The Buyer is responsible for:

a) verifying the legality of the product,
b) importing the product,
c) possessing the product,
d) using the product,
e) complying with the laws of the destination country or territory.

The Buyer acknowledges that legislation regarding hemp and collector’s products may differ between countries.


7. WITHDRAWAL FROM THE CONTRACT

7.1 Consumer’s Right of Withdrawal

Consumers have the right to withdraw from the purchase contract without giving any reason within 14 days from receipt of the goods.

If the contract concerns several types of goods or delivery in several parts, the withdrawal period starts on the day of receipt of the final delivery.

7.2 Method of Withdrawal

Consumers may withdraw from the contract by sending an unequivocal statement to the Seller, for example by e-mail to info@hhclife.cz or in writing to the Seller’s address.

Consumers may use the model withdrawal form attached at the end of these Terms and Conditions.

7.3 Return of Goods

Consumers must send or hand over the goods to the Seller no later than 14 days from withdrawal from the contract.

Goods should be returned undamaged, unworn, clean, including all accessories and, if possible, in the original packaging.

Consumers are liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

7.4 Return Shipping Costs

Direct costs associated with returning the goods are borne by the consumer unless agreed otherwise or required otherwise by law.

7.5 Refunds

The Seller shall refund all payments received from the consumer, including the costs of the cheapest offered delivery method, no later than 14 days from withdrawal from the contract.

However, the Seller is not obliged to refund the payment before the consumer returns the goods or proves that the goods have been sent back.

Refunds shall be made using the same payment method used by the consumer unless agreed otherwise and provided no additional costs arise for the consumer.

7.6 Exceptions to the Right of Withdrawal

Consumers may not withdraw from contracts especially concerning:

a) goods customized according to the consumer’s wishes or for their person,
b) sealed goods that were unsealed after delivery and cannot be returned for hygiene or safety reasons,
c) goods subject to rapid deterioration,
d) goods irreversibly mixed with other goods after delivery,
e) other cases specified by applicable law.


8. COMPLAINTS AND LIABILITY FOR DEFECTS

8.1 Consumer Rights from Defective Performance

The Seller is responsible for ensuring that the goods are free from defects upon receipt and comply with the purchase contract, the description in the online store, and legal regulations.

Consumers may exercise rights arising from defective performance within the statutory period.

8.2 What Is Not Considered a Defect

The following are not considered defects:

a) normal wear and tear,
b) defects caused by improper storage,
c) defects caused by improper handling,
d) defects caused by use contrary to the intended purpose of the product,
e) defects caused by damage to the protective packaging after receipt,
f) damage caused by the Buyer,
g) changes in properties caused by unsuitable storage or exposure to heat, humidity, light, or other unsuitable conditions.

8.3 Filing a Complaint

The Buyer may file a complaint:

a) by e-mail to info@hhclife.cz,
b) in writing to the Seller’s address,
c) by sending the claimed goods to the Seller’s address.

When filing a complaint, the Buyer must provide:

a) order number,
b) description of the defect,
c) requested method of complaint resolution,
d) contact details,
e) photographs or video evidence of the defect if applicable.

8.4 Processing Consumer Complaints

Consumer complaints shall be resolved without undue delay, no later than 30 days from the date of filing the complaint unless the Seller and consumer agree on a longer period.

The Seller shall issue confirmation of receipt of the complaint and subsequently confirmation of the method of resolution.

8.5 Rights in Case of Defects

In the event of a justified complaint, the Buyer has rights according to applicable law, especially the right to repair, replacement, a reasonable discount, or withdrawal from the contract if legal conditions are met.

8.6 Complaint Costs

In the event of a justified complaint, the consumer has the right to reimbursement of reasonably incurred costs associated with the complaint.

9. BUSINESS CUSTOMER COMPLAINTS

9.1 Inspection of Goods by Business Customers

A Buyer who is a business entity is obliged to inspect the goods without undue delay after receipt.

9.2 Reporting Defects by Business Customers

A business entity is obliged to notify the Seller of defects without undue delay after discovering them or after they could have been discovered with professional care.

9.3 Limitation of Liability Towards Business Customers

In relation to business entities, the Seller is not liable for defects arising after the transfer of risk of damage to the goods, especially defects caused by transportation after handover to the first carrier, improper storage, improper handling, or use contrary to the intended purpose of the product.


10. GIFTS, DISCOUNTS, AND VOUCHERS

10.1 Discount Promotions

Discounts, promotional offers, and discount coupons are governed by the conditions specified for the particular promotion.

Unless stated otherwise, discounts cannot be combined.

10.2 Free Gifts with Orders

If the Seller provides the Buyer with a free gift together with the order, the gift agreement is concluded under a condition subsequent that if the Buyer withdraws from the purchase contract, the Buyer is obliged to return the free gift as well.


11. PERSONAL DATA PROTECTION

11.1 GDPR

The processing of the Buyer’s personal data is governed by a separate document called “Privacy Policy”, which is published on the Seller’s website.

11.2 Purpose of Data Processing

The Seller processes personal data mainly for the purpose of:

a) processing the order,
b) delivering goods,
c) issuing tax documents,
d) handling complaints or withdrawal from contracts,
e) communication with customers,
f) fulfilling legal obligations,
g) protection of legal claims.

11.3 Data Sharing

Personal data may be shared especially with carriers, payment service providers, IT service providers, accountants, and other persons if necessary for the performance of the contract or compliance with legal obligations.


12. USE OF THE WEBSITE

12.1 Website Content

All content on the website, including texts, photographs, graphics, logos, and other elements, is protected by legal regulations, especially copyright law.

Without the Seller’s consent, it is not permitted to copy, distribute, modify, or otherwise use the content beyond legal exceptions.

12.2 Website Availability

The Seller does not guarantee uninterrupted availability of the online store.

The Seller is not responsible for outages caused by technical maintenance, failures, third-party interference, or other circumstances beyond the Seller’s control.


13. FINAL PROVISIONS

13.1 Validity of the Terms and Conditions

These Terms and Conditions are valid and effective from the date of their publication on the Seller’s website.

13.2 Amendments to the Terms and Conditions

The Seller reserves the right to amend or supplement these Terms and Conditions.

The wording of the Terms and Conditions effective at the moment of conclusion of the purchase contract is decisive for the Buyer.

13.3 Invalidity of Part of the Terms

If any provision of these Terms and Conditions becomes invalid, ineffective, or unenforceable, this shall not affect the validity of the remaining provisions.
